Second request to reconsider the Board's suspension of all but $1050 of a $1500 late fee assessed against Dwan Troy Johnson, former member of the Terrebonne Parish Levee & Conservation District, for filing his 2017 Tier 2.1 annual pfd 247 days late.
Facts:
Mr. Johnson states that he was not aware of his duty to file a disclosure following the termination of his service in November 2017. As a member, the administration was always helpful with reminders and keeping board members on track. Once his service terminated, he did not have this.


Initial Information:


Dwan Troy Johnson is requesting a waiver for the following reasons:

Mr. Johnson stated he did file his 2017 PFD. However, he had completed and submitted the incorrect Schedule E. Form. He also stated, in no way was he hiding any income received from the Terrebonne Levee and Conservation District. Since then he has submitted the correct filing and listed all monetary disclosures from the Terrebonne Levee and Conservation District on the Schedule E. Form. Mr. Johnson "hopes and prays" that $1500 late fee for not amending his 2017 PFD timely will be waived. This is Mr. Johnson's first delinquency and late filing.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
