Request for an advisory opinion from John Volentine, a Wildlife Agent for the Louisiana Department of Wildlife and Fisheries, relative to supplying a vending machine at various state parks.
Facts:
John Volentine is a Wildlife Agent with the Louisiana Department of Wildlife and Fisheries ("LDWF"). Mr. Volentine is interested in supplying a vending machine near fishing and camping venues in Louisiana. The vending machines would dispense live bait, lures, baits, and sun screen. Mr. Volentine would contract with the Department of Agriculture to place a vending machine at Indian Creek campground in Woodworth, Rapides Parish. Mr. Volentine would also like to consult with Louisiana State Parks and Tourism about placing a vending machine at Bayou Chicot State Park near Ville Platte, Evangeline Parish. Mr. Volentine would not be contracting with the Louisiana Department of Wildlife and Fisheries.
Law:
La. R.S. 42:1113A(1)(a) prohibits a public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
