RE:
Request for an advisory opinion from Larry Chan, former building official for the City of New Orleans, relative to post-employment restrictions.
Facts:
Larry Chan was a certified building official for the City of New Orleans for 33 years until his retirement in January 2020. Mr. Chan's duties included inspections of buildings and other structures to ensure that their construction complied with applicable building codes. Mr. Chan has been approached by a private company to perform inspections for commercial and residential contractors under an agreement between the contractor and the private company. The private company does not do business with the City of New Orleans. Mr. Chan would like to know the the following post-employment prohibitions: (1) Can he perform building inspections in New Orleans on construction that began after his retirement date for his own company, as an independent contractor for another company, or as an employee of another company?

(2) Can he perform building inspections in New Orleans, whether self employed, independent contractor, or employee on a building or construction project he had worked on while employed for the City of New Orleans but the construction is still ongoing?

(3) Can he perform building inspections in New Orleans, whether self employed, independent contractor, or employee on a building that he had inspected while employed for the City of New Orleans, but involves new construction, repairs, or renovations that have begun following his retirement?

Law:
La. R.S. 42:1121B(1) prohibits a public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Allow Mr. Chan to withdraw his request for an advisory opinion.
