Advisory opinion request from Audrey Pugh , Executive Director of Youth Character Camp, relating to provision of youth camp services while she is an employee of the Louisiana Department of Education.
Facts:
Ms. Pugh is currently a part-time employee of the Louisiana Department of Education ("LDE") as an Education Program Consultant 1 in the Office of Teaching and Learning. She is also the Executive Director of a business, Youth Character Camp LLC ("YCC"). YCC would like to provide services offering youth summer camps. In offering these camps, YCC may contract with local school boards. YCC may also seek federal and state grants.
Ms. Pugh's position at YCC is compensated, and she would also like to have family members work for YCC for compensation.
YCC is not regulated by LDE.
Law:
La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are: (d) Neither performed for nor compensated by any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.
Recommendations:
Adopt proposed advisory opinion.
