Waiver request submitted by Michael Wade Holloway, Claiborne Parish Watershed District/Claiborne, regarding a $1500 late fee assessed for filing his 2017 Tier 2.1 annual pfd 408 days late.
Facts:
Wade Holloway is requesting a waiver for the following reasons:

Mr. Holloway stated the annual disclosures are normally mailed from the Claiborne Parish Watershed Office, but that filing year he mailed his own report through a USPS Office. His disclosure was never received by the Board of Ethics, nor returned to him by the post office, so he assumed it to be lost mail. He stated that when he received his second notice from the BOE, he recalled one of his fellow board members receiving a report that had been dated twice, so he assumed there was a scanning error by the office. After speaking with the staff several times, he was informed that his notice was not issued in error, so Mr. Holloway submitted his 2017 PFD in February 2020. Mr. Holloway has served on the Watershed District, the Chamber of Commerce, Claiborne Charity, the Fireworks of Lake Claiborne, and many other boards over the years in Claiborne Parish; and he has voluntarily devoted his time and efforts toward each of the boards at no cost to the tax payers. He would greatly appreciate the consideration of waiving his penalty, as this is a trying time and having to come up with the late fee during economic uncertainties would be extremely stressful for him and his family. He stated his future filings will be mailed with signature required or uploaded to Board of Ethics website.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all but $1050 based on future compliance with the Code of Ethics. Offer a payment plan.
