Waiver request submitted by Tony Lamar Cloud, St. Tammany Parish Sub Drainage Dist. 2, regarding a $100 late fee assessed for filing his amended 2018 Tier 2.1 annual pfd 2 days late.
Facts:
Tony Cloud is requesting a Waiver for the following reasons:

Mr. Cloud stated that "2020 has been anything but normal" He and his wife were quarantined up until Thanksgiving week, when they decided to take a trip to visit his family. They were out of town from November 20th through November 29, 2020; and his wife had the mail held at the post office during that time. The mail was not delivered until Monday, November 30, 2020 and they received a significant amount of mail. He and his wife sorted the mail and placed a stack of envelopes on his office desk. He didn't realize the NOD was time sensitive, until he opened it on Friday, December 4. He is "confident this would not have occurred under any other circumstance or other years" (without pandemic) He would appreciate if the Ethics Board would consider waiving his $100 late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
