Waiver request submitted by Melanie Powell Rey, former member of the Bridge Academy Charter School Board / East Baton Rouge, regarding a $250 late fee assessed for filing her amended 2018 Tier 3 annual pfd 5 days late.
Facts:
Melanie Powell Rey is requesting a waiver for the following reasons:

Mrs. Rey stated on 7/21/2020, she received an NOD requesting she amend her 2018 PFD. She said she filed the amendment on time (post marked date 8/4/2020), but unfortunately it was received five (5) days beyond its due date of 7/30/2020. This delay was due to the COVID-19 Pandemic. As a result of the pandemic, the US Postal Service has experienced delays in processing and delivering the mail. While she commends the postal service for extending shifts to increase postal delivery, the influx of online shopping and postal workers being affected by Covid-19, has substantially diminished the rate and speed at which mail is processed and delivered, especially during the early days of the pandemic (i.e., April - September 2020). It has always been her desire to adhere to her obligations in regards to filing her disclosures. In the past, even when she needed to file an amendment, she visited the BOE to ensure that her disclosure was filled out correctly. "Currently, at this time of unprecedented death, turmoil, financial hardships, and inequities; she would greatly appreciate the Ethics Board waiving her late fee. Mrs. Rey greatly appreciates the Ethics Board's consideration.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
