RE:
Waiver request submitted by Christina Wallace, former member of the Board of Examiners of Certified Shorthand Reporters, regarding a $300 late fee assessed for filing her amended 2018 Tier 2.1 annual pfd 6 days late.
Facts:
Christina Wallace is requesting a waiver for the following reasons:

Ms. Wallace stated that although the USPS Tracking shows the NOD being delivered on 11/16/2020, the letter was not placed in her mailbox until 11/25/2020. She stated because of the COVID-19 Pandemic, the postal worker did not have her sign for the notice, although it was certified mail. She's noticed the mail delivery has been slow since the Covid-19 Pandemic and the street name was misspelled on the NOD as well. She thinks it may have been delivered to the wrong address first, then rerouted to her when she received it, the Wednesday before Thanksgiving on 11/25/2020. Ms. Wallace stated the next business day was 11/30/2020 and she contacted the Compliance Officer who issued her the letter for help. On 12/1/2020, she faxed the amended disclosure. Ms. Wallace is asking the Ethics Board to waive her $300 penalty due to the circumstance outside of her control (the USPS Office).

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
