RE:
Request that the Board waive the $2,000 campaign finance late fee assessed against Chad Doyle, a candidate for City Marshal, City Court, City of Oakdale, Allen Parish, in the October 14, 2017 election, whose 10-G campaign finance disclosure report was filed 433 days late.
Facts:




Chad Doyle requested a waiver and states the following:

He did not realize that he was supposed to file another form since he was unsuccessful in his bid for Oakdale City Marshal. After being defeated, he immediately received a job out of state and left town. He received a letter back in early 2019 which made him aware of the error and he immediately called the Board of Ethics. He spoke to someone who actually walked him through what he had to do. She additionally advised him to ask for help on the fine that would be assessed on him. He stated he did not knowingly or willfully fail to file the required report.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $600 based on Rule 1205C; decline to waive.
