Advisory Opinion Request from Jackie C. Rouse, an employee of the Catahoula Parish Sheriff's Office, regarding becoming a candidate for Catahoula Parish Coroner.
Facts:
Jackie Rouse is currently employed as a Civil Deputy for the Catahoula Parish Sheriff's Office. She also serves as a Chief Deputy for the Catahoula Parish Coroner's Office. Mrs. Rouse's duties with the Coroner's office are on an as-needed basis. The current Coroner is not seeking re-election. Mrs. Rouse asks whether the Code would prohibit her from becoming a candidate for the position of Catahoula Parish Coroner while also being employed as a Civil Deputy by the Catahoula Parish Sheriff's Office.
Law:
La. R.S. 42:1111A(1)(a) prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

AO 2020-614: Employee of the Rapides Soil and Water Conservation District was not prohibited by the Code from running for the elected position of Marksville City Marshall. Board cautioned that Section 1111A would require him to campaign outside of his normal working hours or that he take annual leave.

Recommendations:
Adopt the proposed advisory opinion.
