RE:
Request for an advisory opinion from Corey Oubre, Director of Legal Services for St. Charles Parish, relative to St. Charles Parish entering into a cooperative endeavor agreement with P.A.C.E., a non-profit corporation of which St. Charles Parish President, Matthew Jewell is an officer.
Facts:
P.A.C.E., was formed as a non-profit entity by St. Charles Parish President, Matthew Jewell for the purpose of supporting research, outreach, and education on issues affecting the natural resources of 21 coastal parishes in Louisiana.

On May 17, 2021 St. Charles Parish entered into a cooperative endeavor agreement with P.A.C.E. authorizing a $5,000 annual payment to P.A.C.E. to support its mission.


Law:
La. R.S. 42:1112B(3) prohibits a public servant from participating in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.

La. R.S. 42:1113A(1)(a) prohibits a public servant, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest, from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Decline to render an opinion.
