RE:
Advisory opinion request from Jack Skaggs, former member of Bossier Parish Police Jury, relating to whether a non-profit entity of which he is an officer, may contract with the Parish of Bossier.
Facts:
Jack Skaggs is a former Bossier Parish Police Juror, having stepped down from such role effective June 13, 2021. Mr. Skaggs is also the President and Chief Executive Officer of The Coordinating and Development Corporation ("CDC"), a non-profit corporation. CDC is the state-appointed Planning and Development District for 10 parishes in Northwest Louisiana, including Bossier.
CDC would like to apply for a federal grant on behalf of Bossier Parish, for which CDC may be paid an administrative fee by Bossier Parish. Mr. Skaggs will not be directly involved in the grant application process and did not participate in such matters while serving as police juror.
Law:
La. R.S. 42:1121A(1) provides no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that former agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt proposed advisory opinion.
