Waiver request submitted by Claude T. Bromley, III, former member of the GEO Academy Board Charter School Board, regarding a $200 late fee assessed for filing his 2019 Tier 3 annual pfd 4 days late.
Facts:
Mr. Bromley stated he notified Kevin Teasley, with GEO Academy School Board of his resignation in early 2018. However, when the BOE contacted GEO Academy, the school provided his resignation date effective January 2019. He is unsure about the date discrepancy other than it may have taken time for the school to complete the resignation acceptance paperwork. He ran out of room on his COX email storage and had to delete non-essential emails which included correspondence relating to his service on the board, so he has no proof of when he officially resigned. He did not receive any reminders from the school regarding the annual filing. Mr. Bromley stated he join the board to help the school start-up a local charter school focused on helping black and underprivileged kids get a better education. In addition to spending a great deal of time helping with the start-up, he personally donated $30,000 plus of his own money to GEO Academy. After serving on the board for several years, GEO was up and running successfully and unfortunately, his time commitments had spread him too thin and he felt it was best to resign.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
