Waiver request submitted by Tokyahama Bernette Wright, former member of the Workforce Development Board, Area #83, regarding a $1500 late fee assessed for filing her 2018 Tier 2.1 annual pfd 47 days late and a $1500 late fee assessed for filing her amended 2018 Tier 2.1 annual pfd 127 days late.
Facts:
Tokyahama B. Wright stated in August 2018, her husband's 80 year-old father who had already been diagnosed with congestive heart failure suffered a severe stroke. His parents lived in New Jersey and her husband was handling all of their matters from a distance. In September 2018, they decided place his father under hospice care in Mississippi, and move his mother in with them. Later in September 2018, she and her husband spent 2 weeks in New Jersey to get his parents matters in order. They transferred the Social Security and Medicare Benefits to Mississippi; cleared out their home, made repairs, and put the house up for sale. In addition, they made medical transportation arrangements for his parents, as his father was not in any condition to travel by normal means. Once his parents arrived in early October 2018, they noticed his mother was having a mental breakdown. Within a week of their arrival, her mother-in-law had to be committed her to psychiatric hospital. On October 27, 2018, his father passed away. Mrs. Wright stated the toll of trying to help her husband and mother-in-law was extremely stressful. So stressful, that her marriage was in jeopardy and she had to seek medical care herself. They decided they were unable to care for his mother, so in May 2018, her mother-in-law temporarily moved with her eldest son, while they worked on placing her in a senior-living facility. She and her husband are currently in the process of relocating to Baton Rouge for a fresh start. Mrs. Wright stated she does not have supporting documentation. 'All I have is my word on a very personal matter that still affects me". She apologizes that she filed her paperwork late and asks the Ethics Board to accept her deepest apologizes.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:


Consider the untimely waiver.


2018 Annual - Decline to waive, offer a payment plan.

2018 Amendment - Suspend all based on future compliance with the Code of Ethics.
