RE:
Request that the Board waive a $600 and $2,000 campaign finance late fee assessed against Marcus Bergeron, an unsuccessful candidate for City Marshal, City Court, City of Eunice, St. Landry Parish, in the November 3, 2020 election, whose 30-P and 10-G campaign finance disclosure reports were filed 11 and 175 days late, respectively.
Facts:
Marcus Bergeron requests a waiver and states the following:


He has been dealing with Hurricane Laura and Delta displacements. He was diagnosed with COVID-19 and was bedridden for a month, then his wife was diagnosed with the same and was bedridden for over a month as well. Also, due to the hurricane damage to his listed address, he was forced to move to his current address and did not receive any paperwork or notices that may have been sent from the office. Also, he was under the impression that after he used all his funds for election day expenses and had no more funds, that would be the final report. He was not elected as the City Marshal and did not think a 10-G report was needed since he was not in the general election due to losing in the primary. Once notified of this mistake, he immediately filed the report. This was his first attempt at running in a political office.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

LAC 52:1205(B)(3) states that if a person did not file a report due to a natural disaster occuring on or in the 14 days prior to the report being due, the late fee shall be rescinded.


Recommendations:
With respect to 30-P, suspend all based on future compliance.

With respect to 10-G, suspend all but $200 based on future compliance.
