RE:
Advisory Opinion request from Ernest Fruge, school pyschologist/social worker with Calcasieu Parish School Board, regarding providing autism assessments to children.
Facts:
Ernest Fruge is currently employed by the Calcasieu Parish School Board as a school psychologist/social worker in the Department of Pupil Appraisal. As part of his job duties, Mr. Fruge conducts evaluations, one of which includes an autism evaluation, for children ages 3 - 21 who are enrolled in Calcasieu Parish schools.


Mr. Fruge intends to open a practice, under the direction of a clinical psychiatrist, to provide autism spectrum assessments to children who are not enrolled in Calcasieu Parish schools, such as children in daycare and private school settings. Mr. Fruge would provide these services outside of his normal working hours. Mr. Fruge would accept referrals from private physicians or other third-party providers, but would not accept any referrals of a student enrolled in Calcasieu Parish schools.

Law:
La. R.S. 42:1111C(1)(a): No public servant shall receive any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.


AO 2017-243: Employee of Terrebonne Parish Behavioral Health Center in Houma was not prohibited by 1111C(1)(a) from providing mental health nurse practitioner services to START Corporation, since she was not providing the same services to the same clients of the Terrebonne Behavioral Health Center.


AO 2019-1012: Guidance Counselor at Ellender High School in Terrebonne Parish not prohibited by 1111C(1)(a) from providing job readiness training to students at other high schools in Terrebonne Parish.


Recommendations:
Adopt the proposed advisory opinion.
