Disqualification plan submitted by Nicholls State University regarding Chemistry and Physical Sciences Professor, Dr. Chadwick Young.
Facts:
Nicholls State University submitted a disqualification plan on behalf of Dr. Chadwick Young. Dr. Chadwick Young has been employed in the Department of Chemistry and Physical Sciences since 2005. Dr. Chadwick Young is married to Dr. Kaisa Young. Dr. Kaisa Young has been employed with the University full time since 2012. Dr. Kaisa Young became an agency head in August of 2020. Dr. Kaisa Young has been disqualified and will not participate in the following:


* Any and All employment requisitions (R1/R2) creations related to Dr. Chadwick Young's position;


* Any promotional advancements or pay changes, including academic titles and special awards (e.g. endowed professorships, Presidents award for teaching excellence ect.);


* Performance evaluations;


* Approval of time sheets;

*Approval of travel, and travel advancements and reimbursements;


* Approval of purchase requisitions purchase orders or p-card transactions;

* Approval of fundraising activity;

* Any and all grant documents and funds;

* And any other transactions in which Dr. Chadwick Young would have a substantial economic interest.


Dr. John Doucet, Dean of the College of Life Sciences and Technology will function as the supervisor of Dr. Chadwick Young and Dean Doucet will serve as the approving authority for all issues related to Dr. Chadwick Young.


Law:
La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.

La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1119C(2) provides that the provisions of this Section shall not prohibit the continued employment of any public employee nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employee's immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.


Recommendations:
Approve disqualification plan.
