Waiver request submitted by Landry Thompson Ducote, II, Workforce Development Board, Sixth Planning District Consortium / Area 60, regarding a $1500 late fee assessed for filing his 2019 Tier 2.1 annual pfd 42 days late.
Facts:
Landry T. Ducote, II, is requesting a waiver for the following reasons:

Mr. Ducote stated he completed and saved his disclosure to his laptop, then submitted it, but the BOE never received it. He contacted the BOE and spoke to the Disclosure Director and provided her with all of the email addresses and fax numbers he might have used to submit the PFD. The Disclosure Director, then requested that the IT Department to investigate/track all addresses and numbers that he provided. The IT Department was unable to find a 2019 disclosure submitted Mr. Ducote. When he received the 2019 NOD, he thought it was in regards to his 2018 year, so he disregarded it, which he now knows was mistake and accepts that it was completely his fault. However, he asks the Ethics Board to consider waiving his late fee assessment.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
