Waiver request submitted by Jonathan White, Constable / Ward 7 / Morehouse Parish, regarding a $1000 late fee assessed for filing his 2019 Tier 3 annual pfd 20 days late.
Facts:
Jonathan Larkin White is requesting a waiver for the following reasons:

Mr. Watkins stated got his Louisiana Legislative Auditor (LLA) Constable Sworn Financial Statement mixed up with Louisiana Board of Ethics Annual Personal Financial Disclosure Statement. When Mr. White received his NOD in January 2021, he resubmitted his Constable Sworn Financial Statement to the LLA with a copy of his notice of delinquency from the BOE. The LLA informed him via email that the notice was for the BOE and advised him to contact the Disclosure Director, who was copied on the email. The Disclosure Director replied and provided Mr. White the documents he needed to complete, and he submitted the forms the same day. Mr. White stated he did not sign for his NOD and is unsure who signed the green card. He has made many personal and financial sacrifices to assist his parish and fellow citizens like fixing potholes, ditches, removing downed trees from roads, helping people during hurricanes, flooding, and power outages. He hopes the State of Louisiana would in turn "make some sacrifices for him. Mr. White would appreciate if the Ethics Board would waive his late fee assessment.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
