Waiver request submitted by Joseph Henry "Joe" Lang, former member of the Atlanta Board of Alderman (Pop. 163) / Winn Parish, regarding a $700 late fee assessed for filing his 2019 Tier 3 annual pfd 14 days late.
Facts:
Joseph Lang is requesting a waiver for the following reasons:

Mr. Lang stated he was unaware he was required to file a final disclosure after his term had ended. Once the mayor explained to him why the report was needed, he turned it in. He got married December 2018, and since then he and his new bride have made several trips to Alabama to visit friends, so he was not always available to get in contact with. The certified letter he received the other day (the Late Fee Order) was at the back of his mail box and he did not sign for it. He said, the mayor inquired with the Postal Service and was informed that because of COVID, mail carriers can leave a letter in the box. Mr. Lang did not understand the waiver process after speaking with BOE Staff, so he reached out to the mayor again for help. The mayor called the BOE on his behalf and then explained to Mr. Lang what he needed to do. Mr. Lang has not worked much due to the weather, and he was confused about the filing requirement and waiver, since he does not understand all the rules. He asks the Ethics Board to forgive this matter, since he still helps the Village of Atlanta and mayor when he can. He takes pride in his community and the people and is sorry. He thanks the mayor and Ethics Board for being so helpful in this case.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
