Waiver request submitted by Nancy "Beth" Tycer, former member of the West Feliciana School Board, regarding a $1500 late fee assessed for filing her amended 2018 Tier 3 annual pfd 141 days late.
Facts:
Mrs. Tycer stated she resigned from the board in 2018. She stated the secretary usually notifies them of the annual filing, collects and submits the disclosures all together. She does not recall if she did or did not provide the secretary with her final PFD. She stated when she received her NOD, she tried contacting the agency office several times, but did not get through due to Covid-19 Statewide Agency/Offices shutdowns. In April 2020, her house burned down and she and her family lost everything. Her box of bills along with our NOD were destroyed in the fire. Mrs. Tycer stated she could not think straight. They have 3 children and suddenly had no home, no clothes. Mrs. Tycer stated she does not want the Ethics Board to feel sorry for her, but she "just needs a break". She never lets anything like this happens and it was an honest mistake. She stated she cannot afford to pay the fine right now and asks the Ethics Board to consider all the other years she has filed timely.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all but $600 based on future compliance with the Code of Ethics. Offer a payment plan.
