RE:
Request for an advisory opinion from Ryan Aucoin, a Facility and Risk Coordinator at JCFA East Charter School and JCFA West Charter School, relative to his upcoming marriage to Millie M. Harris, Executive Director of JFCA Charter Management Organization.
Facts:
Ryan Aucoin was hired at JCFA East as a Facility and Risk Coordinator on July 29, 2014. Mr. Aucoin duties as Facility and Risk Coordinator were expanded to the JCFA West campus in December 2017.

On October 9, 2021, Ryan Aucoin intends to marry Millie M. Harris, Executive Director of JCFA Charter Management Organization. Mr. Aucoin will continue to be supervised by Anne Katherine Lene, CAO of JCFA East.


Comments:
Docket No. 2017-660 opined that the Ethics Code would not prohibit the continued employment of the spouse of the Communications Supervisor of the Communications Division within the Zachary Police Department after their marriage, since the spouse has been employed for a year or longer within the Communications Division prior to their marriage.
Law:
La. R.S. 42:1119B(1) prohibits a member of the immediate family of a member of a governing authority or the chief executive of a governmental entity from being employed by the governmental entity.

La. R.S. 42:1119C(2) provides that this Section shall not prohibit the continued employment of any public employee nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employees' immediate family becomes the agency head of such public employee's agency, provided such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.


La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.
