RE:
Request that the Board waive a $1,000 campaign finance late fee assessed against Friends of The Caldwell Parish Library, a political action committee, its committee's chairperson, Randy Braddock, and treasurer, Ryan Chappell, in the November 3, 2020 election, whose 40-G campaign finance disclosure report was filed 5 days late.
Facts:


Randy Braddock, PAC Chairperson, requests a waiver and states the following:


He was unaware that the form was not mailed timely. He said he signed the report on 1/4/21 and the form was to be mailed by Ryan Chappell, Treasurer. His problem with verifying the circumstances that may have transpired that resulted in the report being filed late is that Ryan Chappell was suffering from cancer and unexpectedly died on 3/11/21.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(B)(2) states that if a person did not file a report due to serious medical condition occurring on or in the 14 days prior to the report being due, the late fee shall be rescinded.
