RE:
Request that the Board waive the $1,900 campaign finance late fee assessed against Robert "Rob" Snyder, Jr., an unsuccessful candidate for Judge, Court of Appeal, 5th Circuit, 2nd Dist., Division A in the November 3, 2020 election, and his committee's chairperson, Ruth W. Snyder, whose 10-G campaign finance disclosure report was filed 19 days late.
Facts:
Robert "Rob" Snyder, Jr. requested a waiver and states the following:

There were no contributions or expenditures to report after 11/4/2020 (the day after the general) due to the fact that Facebook stopped all political ads. He changed his address on the 10-G report but all notices were sent to P.O. box addresses. When he qualified, the clerk's office gave him the incorrect schedule. He recently got a new computer with new software and new digital calendar software and there was a technical glitch between his new software and campaign finance's software. He noticed the the computer glitch and contacted staff at Ethics immediately and was informed that he was required to file report.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $1,000 based on Rule 1205C; decline to waive.
