Mr. Morgan states that he was of the belief that the lobbying expenditure report for this period had been submitted timely, but was informed more than two weeks after the deadline that it had not. In past months, when his report was late, he states that he has been informed within two or three days of the late filing. Mr. Morgan states that many of his reports disclose no reportable lobbying expenditures. He states that, as a policy matter, he does not make expenditures that must be reported under statutes and lobbying rules. He also states that the late filing fee is inordinately burdensome and unreasonable. For two years, he has not had any income from lobbying and there is no way that he can possibly pay the amount demanded.
Lobbying staff sent an email on July 27th to Mr. Morgan that our records indicated his expenditure report had not been filed and late fees were accruing. Furthermore, on that same date, staff sent a certified letter to Mr. Morgan about the failure to file. However, this letter was returned to our office September 7th. It was sent to the address used by Mr. Morgan on his reports, which is the address he provided on his waiver request.
