Advisory opinion request regarding whether the Code of Governmental Ethics would prevent Araminta Rainey, an employee of the Terrebonne Parish Department of Housing and Human Services, from enrolling her son in the head start program.
Facts:
The Terrebonne Parish Head Start Program (the "Program") is a federally funded child care and education program for preschool children for low-income families, with eligibility determined by the federal poverty guidelines. The Program provides all services at no cost to participating families. Ms. Rainey's son qualified under the federal standards.

Araminta Rainey currently serves as the Community Outreach Specialist for the Terrebonne Parish Head Start Program. A major function of Ms. Rainey's job is to coordinate and implement all eligibility, recruitment, selection enrollment and attendance activities as required by head start performance standards. Enrollment in the program is limited to 170 students. Only 17 (10%) are allowed to enroll from above-income families. Ms. Rainey decides what children will be admitted into the program. Ms. Rainey receives and reviews the applications for the program.

Law:
La. R.S. 42:1113A prohibits a public servant or a member of such public servant's immediate family or a legal entity in which he has controlling interest from bidding on or entering into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the public servant's agency.

BD #2015-1246, BD # 2011-348 and BD #2011-1692, "Routine and mechanical" was defined generally as something issued in accordance with the rules and procedures of the agency and not with the approval of individual or a board.

Recommendations:
Adopt draft advisory opinion.
