Request that the Board waive the $360 campaign finance late fee assessed against Clara Day, a successful candidate for Justice of the Peace, Ward 5, Livingston Parish, in the November 3, 2020 election, whose 10-G campaign finance disclosure report was filed 9 days late.
Facts:


Clara Day requests a waiver and states the following:


It was never her intention to skip the filing of this document and states she has filed all other reports timely. Her 76 year old mother and 82 year father contracted Covid-19 and her mother died on 11/5/20. In dealing with the death of her mother and her father's illness, she did not realize that she missed the deadline. As soon as she received the delinquency notice the report was filed. She is requesting a waiver of the late fees or to have it reduced or suspended. She said she is not a career politician and she does not have a staff to keep up with her deadlines. She said the $360 fine would be burdensome to her.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

Recommendations:
Suspend all but $100 based on future compliance.
