Request for an advisory opinion from Sgt. M. Laz Wilson, a Digital Evidence Custodian with the Baton Rouge Police Department, relative to post-employment restrictions under the Code of Ethics.
Facts:
Sgt. M. Laz Wilson has been employed with the Baton Rouge Police Department ('BRPD") for 24 years and will retire in January 2022. For the past 4 years, Sgt. Wilson has been a Digital Evidence Custodian in the Mobile Data Division under the command of Lt. Matt Johnson. The duties and responsibilities of a Digital Evidence Custodian include:

(1) Overseeing the software program used to store and manage the dissemination of the digital evidence created by Axon Body Worn Cameras ("BWCs") and in-car camera systems ("Fleet Cameras").

(2) Organizing and managing inventory of BWCs and Fleet Cameras.

(3) Directing and implementing annual training for BWCs and Fleet Cameras.

(4) Managing the BWCs docking stations and offloading systems used by Fleet Cameras.

(5) Scheduling installation of Fleet Cameras by third party contractors.

Following his retirement, Sgt. Wilson would like to contract as a vendor of the BRPD to install, repair and maintain hardware components of BWCs and Fleet Cameras.


Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

La. R.S. 42:1102(23) defines "Transaction involving the governmental entity" to mean any proceeding, application, submission, request for a ruling or other determination, contract, claim, case, or other such particular matter that is the subject of action by the governmental entity, is one to which the governmental entity will be a party, or one in which the governmental entity has a direct interest.
