Request for an advisory opinion from Ben Westerburg, a West Monroe Alderman, regarding whether he may remain employed as a Disc Jockey for K-104 KJLO Radio while a candidate for re-election. |

Mr. Westerburg provided that he is currently employed as a morning show host for country radio station KJLO. He wants to know if he can be a candidate for re-election and maintain his employment as a Disc-Jockey. He stated that the morning show is about county music and entertainment. According to Alderman Westerburg, the morning show is not political. Mr. Westerburg will not talk about his candidacy
on the KJLO morning show and would not promote himself as a candidate during
the morning show. Additionally, the City of West Monroe does
not advertise or purchase any time from KJLO.

La. R.S. 42:1111C(2)(d) provides that no public servant and no legal
entity in which the public servant exercises control or owns an interest in
excess of twenty-five percent, shall receive any thing of economic value for or
in consideration of services
rendered, or to be rendered, to or for any person during his public service
unless such services are neither performed for nor compensated by any person referenced
in R.S. 42:1115A(1).
La. R.S. 42:1115
refers to any person, or any officer, director, agent, or employee of such
person, if such public servant knows or reasonably should know that such person
(A)(1) has or is seeking to obtain contractual or other business or financial
relationships with the public servant's agency.
La. R.S. 18:1483(6)(b)(i) defines "contribution" as including "in-kind
contributions," which include "the donation by any person, . . ., of the
services of paid employees, the value of which services exceeds twenty-five
dollars."
