Request that the Board waive a $3,000 and $1,600 campaign finance late fee assessed against The Voice of the People, LLC, a political action committee, its committee's chairperson, Sidney D. Torres, IV, and treasurer, Michele Chaisson, in the November 3, 2020 election and future election, whose 10-G and 2020 Annual campaign finance disclosure reports were filed 93 and 8 days late, respectively. |

Michael J. Marsiglia, report preparer for the PAC, requests a waiver and states the following:
In connection with the 10-G Campaign Finance report, it appears the report was not timely filed because the election to which Voice Pac was engaged ended on the November 3, 2020 primary election. Jennifer Medley defeated Chris Bruno on November 3, 2020. There was no December 5, 2020 general election for this matter. As seen in the amended 10-G report, no expenditures were made beyond the November 3, 2020 primary election. Committee special reports were routinely filed by Voice Pac from October 16, 2020 up until the November 3, 2020 election, all of which are accounted for on the 10-G report. Thus, all activity referenced in the 10-G report had been formally reported to the Board of Ethics via numerous Special Reports on and prior to November 3,2020.
In connection with the 2020 Annual Campaign Finance Disclosure report, Voice Pac submits that this report was timely filed on February 17, 2021, but was labeled incorrectly as a Committee's Special Report (See report No. 96642). Upon being advised of this error by the Board of Ethics, Voice Pac re-filed its report eight (8) days later on February 26, 2021, correctly labeling it as the Annual Report. Accordingly, Voice Pac respectfully requests that the Late Fee Assessment for the 2020 Annual Campaign Finance Disclosure report be waived due to mislabeling.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.
