Advisory opinion request regarding whether Byron Hurst would be prohibited from being employed with the Louisiana Department of Education as the Deputy Assistant Superintendent for Student Well-Being while serving as a member of the St. Helena Parish School Board.
Facts:
Mr. Hurst is an elected member of the St. Helena Parish School Board representing District 2. He stated that he has accepted an unclassified position with the Louisiana Department of Education as the Deputy Assistant Superintendent for Student Well-Being. He is seeking an advisory opinion as to whether any conflict exists under the Code as to his holding both public positions.
Law:
La. R.S. 42:1111A prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt proposed advisory opinion.
