RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Raymond S. Childress, a successful candidate for District Judge, 22nd Judicial District Court, Division A, St. Tammany Parish, in the November 3, 2020 election, whose 30-P campaign finance disclosure report was filed 28 days late.
Facts:
Raymond S. Childress requests a waiver and states the following:

He qualified for re-election on 7/22/20 and acknowledged that he received material from Ethics. He did not have a campaign committee nor did he solicit or receive any contributions. He reviewed the materials provided and was uncertain if he would be required to file reports. He contacted his CPA who also felt he would not be required to file due to no activity. Obviously, he was incorrect. On 8/20/20, he received the notice of delinquency dated 8/7/20 and he immediately called his CPA to file an electronic filing affidavit and, on 9/2/20, he filed the report.


Mr. Childress also sent additional information showing that his stepson died approximately on week prior to the filing deadline, and they were dealing with funeral arrangements and caring for his grandchild.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(B)(1) provides that a fine may be rescinded if the late filing was due to a death in the immediate family of the person responsible for filing the report within 14 days prior to the report being due.

Recommendations:
Rescind based on Rule 1205B(1) and, accordingly, cancel reassessments triggered by this late filing.
