Advisory opinion request regarding whether the Louisiana Code of Governmental Ethics ("Code") would prevent Toby Henry, a recently elected Justice of the Peace for Terrebonne Parish Ward 7, from continuing to teach medical classes at the Houma Fire Department.
Facts:
Mr. Henry stated that for many years he has contracted with the Houma Fire Department to provide medical instruction. He added that some years he contracts with the Houma Fire Department in his own name and some years he contracts with the Houma Fire Department under his company, Southern Training Consultants. Further, he provided that there is no overlap between the services he provides as Justice of the Peace and as medical instructor. He stated that at no time does his official duties as Justice of the Peace would he be expected to handle an issue regarding the Fire Department.
Law:
La. R.S. 42:1167 provides that all judges, as defined by the Code of Judicial Conduct, shall be governed exclusively by the provisions of the Code of Judicial Conduct, which shall be administered by the Judiciary Commission provided for in Article V, Section 25 of the Constitution of Louisiana.
Recommendations:
Adopt draft advisory opinion.
