Waiver request submitted by Nichole Rogers, M.D., Board of Electrolysis Examiners, regarding a $1100 late fee assessed for filing her 2019 Tier 2.1 annual pfd 22 days late and a $1500 late fee assessed for filing her 2020 Tier 2.1 annual pfd 60 days late.
Facts:
Nicole Rogers is requesting a waiver for the late filing of her 2019 & 2020 Annual PFDs stating that her hair restoration practice was closed from mid-March 2020 to mid-May 2020 due to the Covid-19 Pandemic. She has served on the Louisiana Electrolysis Examiners Board for over 10 years and each year has diligently submitted her PFD on time. She is not clear how this late filing happened. Ms. Rogers stated perhaps the mail was disrupted since she did not receive the NOD -FF. She and her boyfriend moved to a new house in 2018 and she didn't notify the BOE of the move. (NOD -FF was mailed to the new home address she mentioned). Ms. Rogers stated she is not paid for her time and enjoys providing her services to the board. She asks the Ethics Board to please waive her late fee assessment.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
2019 - Suspend all based on future compliance with the Code of Ethics.

2020 - decline to waive.
