Request to waive the $150 and $800 late fees assessed against Carol Smith for failure to timely file a Supplemental Lobbying Registration Report and a June 2021 expenditure report.
Facts:
Ms. Smith states that as the documents show, she was to file a supplemental filing following the submission of her termination of her active lobbying status. She states in early April, she discovered that she may have breast cancer, a diagnosis which was ultimately confirmed and for which she underwent treatment and surgery. She states that her medial care and her survival became her priority and it became difficult to think or focus on anything else. She states that after her surgery the lobbying staff reached out to her to inform her of the delinquent filing, unaware of her diagnosis and that she was one day post hospital discharge. Ms. Smith advised the lobbying staff of her diagnosis and the medial and emotional strain. She is still undergoing treatment for her diagnosis.

Law:
24:55 La R.S. 24:55 provides that registered lobbyist shall file a monthly expenditure report by the 25th day of the subsequent month.

24:58 Any person required to register and who fails to timely register and any person who fails to timely file any report required by this Chapter shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars.

24:53 Within ten days of termination of a registrant's employment or representation of any person, the registrant shall file a supplemental registration with the ethics board acknowledging the termination of his/her employment or representation.

Rules 1205B(2) provides that a late fee shall be rescinded if on the date the report is due, or the 14 days prior thereto, the filer experienced a serious medical condition which prevented the person from filing the report timely.




Recommendations:
Waive the $150 and $800 late fees. Do not reassess the $450 late fee.
