Waiver request submitted by Jasmyne McConnell, Southside Economic Development District, regarding a $900 late fee assessed for filing her 2019 Tier 2.1 annual pfd 18 days late.
Facts:
Jasmyne McConnell is requesting a waiver for the late filing of her 2019 Annual PFD and stated that she was appointed to the Southside Economic Development District (SEDD) Board in 2018, and had never occupied a seat on a board that required a financial disclosure. In an effort to submit them timely, the SEDD Board executive director submitted the PFD'S on behalf of all board members. She did not realize that it was for the 2018 filing year. Due to the Covid-19 Pandemic the board was unable to make quorum, and was unable to hold regular meetings during most of 2020. She was unaware that she needed to file the 2019 and 2020 disclosures. She stated that due to Covid-19, certified mail no longer requires a signature, and she did not get the NOD-FF until her husband gave it to her a week after the received date was written on the green card. She states she then contacted the BOE and was it was explained to her the filing process and filing time frames. Ms. McConnell stated this was an honest mistake and asks the Ethics Board for their consideration in waiving her fine.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
