Waiver request submitted by Stephanie M. Webb Guileyardo, Capital Area Human Services District, regarding a $300 late fee assessed for filing her 2019 Tier 2.1 annual pfd 6 days late.
Facts:
Stephanie Webb Guileyardo is requesting a waiver for the late filing of her 2019 Annual PFD and states that she has been employed by the Dept. of Corrections, Division of Probation and Parole for 24 years. During the time the 2019 PFD's were due, she was responsible for a portion of her departmental response to the COVID-19 Pandemic. Starting May 23, 2020, she was working nearly 24 hours a day, 7 days a week, and was responsible for the coordination of all state Probation and Parole Officers providing security for inmates housed in area hospitals. She coordinated safe movement of officers from one part of the State to another and movement of inmates from hospital to hospital or returning to their assigned facility. During this time, she also maintained her regular role as Reentry Program Manager acting as point of contact for officers, service providers and all formerly incarcerated persons returning to the Baton Rouge and the Feliciana area. She tried to submit her financial disclosure on time, but unforeseen circumstances prevented her from making the deadline. She serves as a volunteer on the Capital Area Human Services District Board and asks the Ethics Board to waive her late fee assessment.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
