Waiver request submitted by Donna Mann Green, Pine Hill Water Board District #8/Caddo Parish, regarding a $550 late fee assessed for filing her 2019 Tier 2.1annual pfd 11 days late.
Facts:
Donna Mann Green submitted a waiver for the late filing of her final annual disclosure and states that after leaving the Pine Hill Water Board District # 8, both her father and mother (who suffers from Dementia) ended up on Covid-19 Pandemic lockdown in West Monroe, for a year. She was not timely receiving her mail and was traveling back and forth from Shreveport to West Monroe since she was in the process of moving to West Monroe. While moving a lot of her documents were packed away. During this time, she was also diagnosed with Covid, and is still paying hospital bills for treatment and some other Covid related illnesses. Mrs. Green apologizes for the late filing as she thought she was finished with filing the disclosures, once she was no longer on the board. She asks the Ethics Board to waive her fine due to the circumstances of moving and COVID-19, which led to her filing the PFD late.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
