Waiver request submitted by Tara Elaine Bell Hawkins, former member of the Lake Charles North Redevelopment Authority, regarding a $650 late fee assessed for filing her 2018 Tier 2.1 annual pfd 13 days late and $650 late fee assessed for filing her 2019 Tier 2.1 annual pfd 13 days late.
Facts:
Tara B. Hawkins is requesting a waiver for the late filing of her 2019 PFD Statement and states that she resigned from the Lake Charles North Redevelopment Authority (LCNRA) on February 27, 2019. She filed her first Annual PFD during her 2018 tenure, but was unaware that she was required to file annually. Ms. Hawkins assumed she was no longer required to file once she resigned. She did not expect that a 2019 disclosure would still be applicable. Once advised that the disclosures were still required, she filed a compliant disclosure. She stated she was not paid while servings as a volunteer commissioner. In light of her "personal time and costs expended to serve, and her efforts to properly notify the City of Lake Charles of her resignation, she states the fine should be waived. Moreover, such an unexpected fine of this large amount for disclosures, unknowingly due in the months and subsequent year after her departure, for a defunct entity is a hardship and serves no useful purpose." Ms. Hawkins stated there was no willful or unduly negligent behavior.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
