Untimely waiver request submitted by Antoine L. Jackson, Eastover Property Owners Association, regarding a $1500 late fee assessed for filing his 2017 Tier 2.1 annual pfd 110 days late.
Facts:
Antione L. Jackson is requesting an untimely waiver for the late filing of his 2017 PFD Statement and states that his late filing was not done intentionally, as he was deployed overseas in Iraq in 2018 and 2020. During that time, receiving mail and trying to keep track of filings was very cumbersome. He remembers getting a call from the BOE and speaking with a staff member while stationed in Iraq. Additionally, his prolonged lateness is because he was unable to sort through a backlog of mail, upon returning from overseas. Mr. Jackson stated the entire election cycle and filings were new to him, and somewhat difficult to understand. There were several significant concerns and lawsuits involving the board when the 2017 PFD was due. To reduce compliance issues, the office secretary recommended sending all disclosures to the BOE at once, so he emailed his PFD to his district board. He was unaware the neighborhood association failed to submit his disclosure to the BOE. Mr. Jackson stated he is simple resident who only wanted to get more involved. His lack of knowledge regarding filing requirements, the failures of the Eastover Administration, and the additional hardships of being deployed are the reasons for his late filings and why Mr. Jackson asks the Ethics Board to accept his request and waive his late fee assessment.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Consider the untimely waiver request.

Suspend all but $450 based on future compliance with the Code of Ethics. The $450 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
