RE:
Request that the Board waive a $1,080 campaign finance late fee assessed against J. Schuyler Marvin, a successful candidate for District Attorney, 26th Judicial District Court, Bossier and Webster Parishes, in the November 3, 2020 election, whose 2020 Supplemental campaign finance disclosure report was filed 18 days late.
Facts:
Angela Lawrence, treasurer for J. Schuyler Marvin, requests a waiver and states the following:
She requested an extension of the due date, but was told that was not allowed and that she can request a waiver of the late fee. She is requesting the waiver for several issues including the change in the Treasurer for the campaign on 2/15/21. Their offices were significantly impacted by COVID shutdowns as well as water and electrical outages from the February ice storms in North Louisiana.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(B)(3) provides that a fine may be rescinded if the late filing was due to a natural disaster affecting the person responsible for filing the report within 14 days prior to the report being due.


Recommendations:
Rescind based on Rule 1205B(3).
