RE:
Request for an advisory opinion from Kurt Evans, relative to whether his company, Digital Engineering, could contract with Atlas Technical Consultants, LLC, an entity that employs Matt Butler, who serves on the Baton Rouge Metropolitan Airport Commission ("BOC") while Digital Engineering has entered into a contract with the BOC.
Facts:
Kurt Evans is the CEO of Digital Engineering, a Louisiana corporation that contracts with the BOC to provide engineering services. Matt Butler currently serves as a member of the BOC and is employed by Atlas Technical Consultants, LLC, however, he has no ownership interest in the company. Mr. Butler serves as the Senior Vice President of Louisiana Operations for the company. Digital Engineering would like to enter into a contractual agreement with Atlas Technical Consultants, LLC to provide engineering services as a prime or sub-consultant. Atlas Technical Consultants, LLC would provide no services related to any engineering services being provided to contracts associated with the BOC. Matt Butler would have no involvement with the contract between Digital Engineering and Atlas Engineering, nor would Mr. Butler be compensated as a result of the contract.
Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant and any legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, from receiving any thing of economic value for services rendered from a person who has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.
