RE:
Request that the Board waive the three (3) $1,000 campaign finance late fees for a total of $3,000 assessed against David Charles Logan, Sr., an unsuccessful candidate for Mayor, City of Bastrop (Pop. 9,691), in the March 20, 2021 election, whose 30-P, 10-P and 10-G campaign finance disclosure reports were filed 48, 29 and 58 days late, respectively.
Facts:
David Charles Logan, Sr. requests a waiver and states the following:


When he qualified he was only given the PFD packet and was not informed of campaign finance filings. He said a few days after the election someone familiar with the campaign process shared some campaign reporting information and pointed out that he needed to complete the 30-P, 10-P and EDE reports. He was also informed where to find those forms online and he completed them. He did not learn until much later that he was also required to file 10-G. He does not have the assets to satisfy the assessment fees and that it would be a financial hardship to pay fines.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

Recommendations:
Suspend all but $200 for each ($600 total) based on future compliance. The $600 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
