Waiver request submitted by Jamie U. Huval, Aldermen for the Town of Arnaudville (Pop. 1009) / St. Martin Parish, regarding a $325 late fee assessed for filing his amended 2019 Tier 3 annual pfd 13 days late and a $325 late fee assessed for filing his amended 2020 Tier 3 annual pfd 13 days late.
Facts:
Jamie Huval is requesting a waiver for the following reasons:

Mr. Huval stated that on 10/18/2021, he received two LFO's and he has never filed late before. Mr. Huval stated the notices were delivered to his address, but he did not sign for them. He did not receive the letters immediately, but once he got them, he knew this had to have been a mistake since he filed his disclosures on 4/12/2021. A bit perplexed and certainly frustrated, he states he called the BOE on 7/21/21 and was transferred to the Compliance Office that issued him the letters. She was unavailable, so he left her a voicemail. He claims he never heard back from her, and called back 3 more times and left her messages, but did not receive a return phone call until August of 2021. He states the Compliance Officer informed him that yes he had filed the disclosures, but he submitted the wrong Tier Level forms for both 2019 and 2020. Mr. Huval is requesting all his late fees be waived, since he did file on time; he made several attempts to contact the BOE after receiving the notices; and corrected his errors (via fax) the same day he spoke to the Compliance Officer.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
