Waiver request submitted by Levi Lewis, Sr., former Washington Parish Council Member / District 4, regarding a $2500 late fee assessed for filing his 2019 Tier 2 annual pfd 189 days late.
Facts:
Loleta Lewis-Sartin is requesting a waiver request on behalf of her father Levi Lewis. Mr. Lewis has been under the medical care of a doctor since January 2020 for progressive memory loss. Mrs. Sartin stated her father started showing signs of memory decline after the unexpected death of her brother (a year prior to his treatment). Her mother has a history of memory and cognitive issues since her stroke in 1997. Her father, Mr. Lewis was her mothers' primary caregiver, but he has not been able to care for his wife due to his declining health. Mrs. Sartin stated since Mr. Lewis's health has severely declined, her parents now live with her sister and brother-in-law. Mrs. Sartin stated she was unaware her father was delinquent in filing his reports, until she found a pile of unread mail dated back to 2019. Both she and her sister now manage their parents' business and provide support/care to ensure their parents remain safe. Mrs. Sartin asks the Ethics Board to please waive her father's late fee and forgive his late filing. She thanks the Ethics Board for their consideration.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Waive the late fee.
