Waiver request submitted by Steven Leon, Hammond City Council (Pop. 19,584) / District 5 / Hammond / Tangipahoa Parish, regarding a $250 late fee assessed for filing his 2020 Tier 3 annual pfd 10 days late.
Facts:
Steven J. Leon is requesting a waiver for the following reasons:

Mr. Leon stated this is his first time as a councilman (elected 11/6/2018), and although he's tried very hard to keep up with deadlines, policies and procedures, the past months have been very difficult. He stated the Failure to File Notice issued 10/1/2021, delivered 10/4/2021, was not seen until 10/20/2021. He is a retired state employee and is currently working at OPTIONS Inc., a non-profit service, assisting over 150 people with intellectual disabilities. During Hurricane Ida, he managed four shelters and generators for 2 weeks to help those displaced individuals and families. Also, Hurricane Ida completely destroyed his mother's (85) home and his father-in-laws' (86) home. Both parents are now living with him and his spouse. During this time, he was utilizing several small generators at his home for their bare necessities, as they were without power for 22 days. He did not have internet for a month. Mail delivery was halted. Hurricane Ida hit his council district very hard, with both extreme wind damage and flooding. He received countless calls, text and emails daily regarding recovery next steps. As of today, much of his district still looks like "a war zone." He asked the Ethics Board to consider waiving his late fee assessment.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
