Request to waive the $800 late fee assessed against Amanda Derise for the late filing of her 2021 Lobbying Registration.
Facts:
Mrs. Derise states that it was brought to her attention that the state requires a lobbying registration and that the registration would only be required for her role if she was to perform any lobbying activities with a member of Louisiana's Medicaid Pharmaceutical and Therapeutic Committee. When she was completing the registration process, she listed October 1, 2021 as the first day she participated in lobbying activity. Mrs. Derise states that this was inaccurate as she has not, and will not participate in any type of lobbying activity. Since she did not know the details, she was unsure of what date to list and assumed that it would be best to list the first day of the month for which she was completing the registration. Due to her registration being completed on October 22, 2021, this triggered an $800 fine, which she is requesting to be waived.

Staff Notes: In her initial registration, her date of first action was entered as 10/1/21. To complete the registration process, she needed to submit the registration fee of $110. The registration process needed to be completed by 10/6/21. She did not complete this process until October 22, 2021. Also, Mrs. Derise submitted a supplemental registration report to terminate her lobbying registration. Initially, she was assessed a $1,500 late fee for not timely filing the supplemental registration. However, based on an amendment to the supplemental registration, that late fee was rescinded.

Law:
R.S. 49:74 provides that "[e]ach lobbyist shall register with the ethics board as soon as possible after employment as a lobbyist or after the first action requiring his registration as a lobbyist, whichever occurs first, and in any event not later than five days after employment as a lobbyist or not later than five days after the first action requiring his registration as a lobbyist, whichever occurs first."
Recommendations:
Waive the late fee.
