Request that the Board reconsider its decision to decline to waive a $3,000 campaign finance late fee assessed against Black Organization for Leadership Development, in its capacity as a political action committee, its committee's chairperson, Darren Mire, and treasurer, Priscilla Edwards, in the November 3, 2020 election, whose 10-G campaign finance disclosure report was filed 11 days late.

Original waiver request stated:


He can't explain why the report was not received. He provided a copy of an envelope with the postmark date of 11/25/2020. With the issues of getting signatures and obtaining the leaders online access username and password, he states they were instructed to go ahead and mail in the report. He personally dropped the report off at the post office that night because they had not heard back from IT. If you take a look at BOLD'S past filing you will see a history of timely filed reports and this was an isolated event.
Report was received on 11/25/2020 in paper form.



Reconsideration request states:

Sheldon Bruno the report preparer for PAC, requests a reconsideration and states the following: After additional research and communication with Campaign Finance, they located the original 10-G Campaign Disclosure Report for that November 3, 2020 Election that was mailed on November 25, 2020. Also, Campaign Finance was able to see where discussion between us and a supervisor was made on the 25th of November and again, he wants to reiterate that they were instructed to mail in the Report.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.


Recommendations:
Reaffirm decision to decline to waive.
