Request that the Board reconsider its decision to decline to waive a $3,000 campaign finance late fee assessed against Falconer PAC, a political action committee, and its committee's chairperson, Reid Falconer, in connection with the July 11, 2020 election, whose 30-P campaign finance disclosure report was filed 461 days late.
Facts:


Reconsideration stated: The information required to be contained in the 30-P was contained in the 10-P, which was timely filed.


Original request stated: A check was cut to candidate Jill McGuire in the amount of $200 on 2/12/20 which was originally in connection with the April 2020 election. Beginning in March, they were beginning to face many uncertainties in connection with the pandemic which in turn caused some confusion. Upon later looking at the filing schedule, the schedule began to change and the PAC had full intentions on staying in compliance but failed to file what they had assumed was no longer a valid filing schedule and deadline.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
