RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against American Sugar Cane League, a political action committee, its committee's chairperson, Frankie Sotile, and treasurer, John Constant, whose August 2021 Monthly Report campaign finance report was filed 5 days late.
Facts:
John Constant, Treasurer for the PAC, requests a waiver and states the following: Typically they do not have difficulty meeting the monthly deadline, but their area in Lafourche Parish was dealt a difficult recovery following Hurricane Ida. He said that although their office was spared any physical damage, they were unable to conduct any operations from the office due to lack of power and internet services. He asks for consideration and understanding of the unintended consequence of having the inability to conduct normal activity for over 15 days. He asks that the Board waive the late fees based on their situation like so many in their community.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205B(3) states that if, during the 14 days prior to the report being due, a natural disaster prevented the filer from making the report, the fine shall be rescinded.


Recommendations:
Rescind based on Rule 1205B(3).
